Any time a person writes or draws something in their own words or with their own hand, they gain certain rights to the material that they have created. In this case, the source material is not their own, but the product itself is. Granted there is no real legal concern if you felt the need to undertake this task due to there being no financial entanglements, however I would highly recommend you do two things - 1: get the author's permission, and 2: credit the author for his or her work (I notice that only your name appears in the thread title). If you don't do these things then sure, legal prosecution is unlikely, but you will be generally hated and abused because it constitutes theft, not a helping hand.
If he or she has given you permission, then it's a different story and you're free to go ahead.
