If the government is keeping a lid on the mutant issue why are they issuing day passes?  I do want to know how they got down there to begin.

Two or three+ years pass between ISTE and LTH.  Most likely, mutants became common knowledge sometime in between - nobody was surprised because they had "known" it all along.  Therefore, Citihall's policy was changed: they admitted the existence of mutants and started granting them day passes.  They still have to live in the sewer, though...

You know those crazy laws that have been around forever but are never actually inforced? The really off the wall ones like it's illegal to tie a giraffe to a pole? Well some of them are urban legands and actually aren't true. Maybe some people believed that the mutant day pass program was something like that. They either didn't believe it existed or believed it was some off the wall government stunt.
